AP stamps and registration: Calculation of stamp duty

We show with an example, how you can calculate stamp duty for IGRS AP deed details. If a home buyer Ram is purchasing a flat for Rs 70 lakh, then the applicable stamp duty is five percent and registration charge is 0.5 percent.  Also, applicable will be a transfer duty fee of 1.5%

So, Ram will pay stamp duty of 70,00,000 * 5/100= Rs 3,50,000 lakh.

Registration charge for AP deed details will be = Rs 70, 00,000*0.5/100= Rs 35,000

Transfer duty fee for AP deed details will be = Rs 70,00000*1.5/100 = Rs 1,05,000

Thus, Ram will have to pay a total AP stamps and registration cost of Rs 4,90,000 or Rs 4.9 lakh.

Taking into consideration all these charges, the total cost of the property purchased by Ram is

Rs 70 lakh + Rs 4.9 lakh = Rs 7,4,90,000 lakh or Rs 74.9 lakh.

AP stamps and registration: How to pay stamp duty?

For paying stamp duty charges in AP, you have options including- submitting stamp paper to stamp vendor, use of franking machine or opting for e-stamping. For paying stamp duty charges in AP using stamp paper, you can use options like cash, demand draft, debit card and credit card etc. If you are using a franking machine, the charges for stamp duty has to be paid at a franking outlet. Here’s a step-by-step guide to register property in Stamps and registration AP department:

Step 1: Obtain all the important documents and deed details required for stamps and registration AP under IGRS AP.

Stamp duty refund

If the stamp duty is paid using challan, the registrant public can use it whenever he wishes to. For any stamp duty refund to be claimed, the maximum limit is six months.  The party seeking refund of stamp duty has to apply to the concerned District Collector/Sub Collector/ Deputy Collector/ R.D.O/ Tahsildar under section 2(9) of I.S Act, through the Sub Registrar. He has to state the reasons for seeking refund along with original challan issued by the Bank. The Sub-Registrars on receipt of such application will verify the genuineness of the challan, check if it’s still not used and then issue a certificate to that effect. Based on the certificate issued by the Sub Registrar, the amount will be refunded after deducting 10% of the total stamp duty.

Note that in view of the second wave of COVID-19, there was no revision in the market value of land in A.P. in 2021. This holds true for AP stamps and registration market value too that would have otherwise been implemented from August 1, 2021.  According to the notification issued by the Andhra Pradesh government, the current existing AP registration market value of properties will hold true till March 31, 2022.

The Encumbrance Certificate is AP land registration or AP property registration certificate documents required for property registration AP. An applicant can easily download the EC AP from the online portal, using following procedure:

Step 1: Visit the AP stamps and registration portal (click here).

Step 2: Click on ‘Encumbrance Search (EC)’ from the right menu for AP stamps and registration EC.

  2. Survey number in a revenue village, optionally described by a plot number.

Types of AP stamps and registration Encumbrance Certificate (EC)

There are two types of AP stamps and registration EC -encumbrance certificates: Form no 15 and Form no 16.

Form no 15

AP stamps and registration ec on Form no 15 contains a record of sale, lease, mortgage, gift, partition, release, etc. All of this will have to be registered with the competent authorities and placed on record in Book I that is maintained by the registering authorities for the specific period that the certificate is being asked for.

Form no 16

Form no 16 is issued when there is nothing by way of transactions for the time frame that the certificate is being sought for.

March 23, 2022

Digital stamps and online payment for IGRS AP deed details registration to be rolled out

AP stamps and registration is going to introduce digital stamps and online payment for registration of IGRS AP deed details at village/ ward secretariats, as per a Deccan Chronicle report.

The Andhra Pradesh government has signed a MoU with SHCIL for digital stamps sale. The government will also sign an agreement with the village/ward secretariats, common service centres and stamp vendors for digital stamps sale. Also, close to 3,000 centres for digital stamps sale will be set up soon. IGRS AP deed details registration at 37 village/ward secretariats has kickstarted in the state.

IGRS AP is also working at initiating a process to pay charges with respect to registration of IGRS AP deed details, user charges and stamp duty at SCHIL centres instead of paying via document writers in banks with the help of challans.

No hike in market prices till March 31, 2022

The Andhra Pradesh government has decided not to make any upward revision in the market value AP of immovable properties till March 31, 2022.  According to the notification published by the state government, the current market value of land in A.P. in 2021 will remain in force, without any revision, till March 31, 2022. Further, the government has postponed the date of implementing periodicity of revision till March 31, 2022, although as per provisions it should have been implemented from August 1, 2021.
